PRIVACY POLICY
The General Data Protection Regulation (EU 2016/279) (GDPR), together with the ePrivacy Regulation (EU 2017) (ePR, currently still in draft), are the revised data protection and privacy laws that will replace current data protection legislation in all EU member states; in the UK the legislation being replaced is the Data Protection Act 1998 (DPA) and the Privacy and Electronic Communications Regulation 2003 (PECR).
The new laws were enacted across all 28 EU Member States on 25th May 2018.
The changes will apply to all businesses based in the EU, or those in other countries who provide goods or services with anyone residing in the EU. This is equally applicable to sole traders and large corporations.
Our policy exists to ensure that we comply with obligations equivalent to those of the 7th Data Protection Principle.
Under data protection law, we can only use your personal data if we have a proper reason for doing so. We have identified that the lawful bases for processing applicable to the data we hold are:
- to comply with our legal and regulatory obligations;
- for the performance of our contract with you or to take steps at your request before entering into a contract;
- for our legitimate interests or those of a third party;
A legitimate interest is when we have a business or commercial reason to use your information, so long as this is not overridden by your own rights and interests.
This policy details how we will use your information, and we wanted you to know how we are managing and using the data we hold.
What data we hold
We currently keep information including, but not limited to, first name, last name, email address, address, telephone number and a historical record of conversations, correspondence and communications. We may also have your date of birth and other personal information if you have provided this to us.
What we use your data for
All data is held in a password protected system.
We may provide some of your information to your lender if you have a loan on your property, to Managing Agents, Insurance Brokers and Insurers, Solicitors, our auditors and HMRC.
Any data we keep about you is never used for marketing purposes. We only use this information in relation to the services we offer.
Your Rights
You also have the right, under the General Data Protection Regulation, to have access to your data and to have it erased. Such requests are dealt with on a case-by-case basis, although certain data will need to be kept for compliance, legal and HMRC accounting needs.
Changes to our Privacy/Data policy
Should we revise our data policy in the future we’ll provide you with notification or refer you to our privacy policy which will be available on our website (www.nominal-land.net).
